I. TERMS AND CONDITIONS POLICY GOVERNING USE OF WEBSITE

As an international humanitarian organization, Connecther ("we", "our", "us", "Non-profit", or "Organization") understands that your trust is key to achieving our fundraising goals. We encourage you to review our policy governing your use of this Website. When changes are made to our website, Connecther posts the date on which any such changes are made by referencing to "last updated" date at the end of this policy.

A. ACCEPTANCE OF THE AGREEMENT

These Terms and Conditions govern your use of the website, Connecther.org, ("Website") and its services. The Terms and Conditions should be read carefully and understood before using any of the site or its services. By using Connecther.org and its services, you agree to abide by these Terms and Conditions. These Terms and Conditions may be updated or modified from time to time. You can review the most current version of the Terms and Conditions at any time by visiting www.connecther.com. If there is any disagreement with these Terms and Conditions you should not use Connecther or any of the services it provides. These Terms and Conditions are a legally binding agreement between yourself and Connecther.

B. PROPRIETARY RIGHTS

You understand and agree that your use of the website and its services entitles Connecther to use, monitor and preserve copies of all information and content on and submitted to the Connecther website and to disclose such information if so required by law or in the good faith believes that it is required to do so.

The content available on the Connecther website is owned by Connecther and other third parties. It is protected by the United States Copyright Act of 1976, and the copyright laws of other nations. Certain materials are used by Connecther with the permission of their respective owners. The Content of the website, may not be reproduced, republished, transmitted, or distributed in any way without the prior written consent of Connecther. However, Connecther authorizes you to view or download a single copy of the Content provided that you keep intact all copyright, trademark, and other proprietary notices. Connecther reserves the right to terminate your use of the Services in appropriate circumstances if you infringe upon the intellectual property rights of Connecther or any third party. In accordance with the Digital Millennium Copyright Act of 1998, 17 U.S.C. 512(c)(2), Connecther's designated agent for notice of alleged copyright infringement involving Connecther.org is Aisha Malik.

C. ACCEPTABLE USE OF THE WEBSITE

Connecther is an international humanitarian organization that connects donors with nonprofit projects that are designed to help women in poverty in their quest for self-reliance. Connecther.org contains a database of Project Partners, which are Public Charity organizations under section 501(c)3 of the Internal Revenue Code.Any current 501(c)3 non-profit organization can apply to be a Project Partner, but final approval is subject to review by Connecther. In this light, Connecther only funds projects of existing 501(c)3 non-profit organizations providing economic, health, or education services to poor women in developing communities. Also, since Connecther aims to match public charity organizations with potential donors, profit-making companies are not eligible for Project Partner consideration. We encourage Project Partner applicants to submit information to Connecther.org giving general information about the organization and the scope of fundraising goals. The Project Partner database is open for anyone to search and access information contained in it.

Like other successful grant matching organizations, Connecther.org will facilitate the giving process so that donors can immediately choose and donate to whichever projects they would like to fund. In order to link public charity organizations with potential donors, individuals can use the Connecther site to access the Project Partner database and to discover projects they wish to support. Individuals will create a user profile which will include information about themselves and their interests. Connecther.org helps our Project Partners to reach out to their membership to show a collective-giving impact. For this reason, Project Partners will have access to this database of such individual profiles for purposes of finding people who may be interested in donating to their projects.

Connecther believes that transparency in donation activity plays a fundamental role in matching public charity organizations with potential donors. Since Connecther.org is designed to facilitate group donations to show the collective impact of fundraising, there may be instances where excess money is left over when a project has either achieved its fundraising goals or has reached the maximum project funding allowance permitted by Connecther. Accordingly, Connecther wants potential donors to be reassured that our organization has safeguards in place which aim to place any excess money funded to a project towards similar projects helping women in their quest for self-reliance.

D. DISCLAIMER / LIMITATION OF LIABILITY

Connecther is not responsible for any content posted on the Connecther website by Project Partners or individuals. Connecther retains the right to remove any information it deems to not be appropriate. Content deemed by Connecther to be offensive or content found to be infringing on the rights of others are examples of non-appropriate content. If unsure about the content being posted, contact Connecther for information regarding its appropriateness. Connecther is not responsible, and shall have no liability, for any incorrect or inaccurate Content posted on the Website or any liability, cost or expense you may incur in connection with the Program, whether caused by any User, Field Partner, Borrower or other Person or by any of the equipment or programming associated with or utilized in the Program. You also acknowledge and agree that Project Partners are not liable for content created and posted by Connecther on the Website. Connecther is not responsible for the conduct, whether online or offline, of any User of the Website or any other Person. With respect to the Website, Connecther assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, any communications.

Under no circumstances will Connecther be responsible for any loss or damage, including personal injury or death, resulting from any use of the Website or participation in a Project. Connecther neither represents, warrants, guarantees, nor promises any specific results from use of the Connecther website.

Connecther makes no representation or warranty, express or implied, with respect to any third party data provided to Connecther. Connecther will not be liable in any way to you or to any other person for any inaccuracy, error or delay in or omission of any third party data.

E. CONNECTHER TRANSACTION FEES

We are committed to keeping our overhead small so that our fees remain amongst the lowest in the industry. Connecther reserves 7.9 % + .30 per transaction of donated funds for administrative costs such as processing your donations securely via paypal, hosting our site, finding and vetting 501c3 nonprofit project partners, etc.

Nonprofits are like any other business in the sense that they still require money to function and grow. Think of it this way: 92.1% goes to the recipient organization, 7.9 % + .30 per transaction towards leveraging those funds in ways that will serve women in need in the long term. For a $25.00 donation, $22.73 goes to the project, $2.27 goes to Connecther.

F. GOVERNING LAW

This agreement between you and Connecther is governed by the laws of the State of Texas. Any dispute between you and Connecther will rest exclusively in the courts of Travis county, Texas and the federal courts of the Western District of Texas.

G. INDEMNITY CLAUSE

You agree to hold harmless and indemnify Connecther and its affiliates from and against any and all third party claims or demands and any losses, liabilities, damages, costs, payments and expenses, including reasonable attorneys' fees that could arise out of your use of the Connecther website or Services.

H. TERMINATION OF AGREEMENT

This Agreement will remain in full force and effect while you use the Website, use any Connecther services, or participate in the program as a user and, notwithstanding anything herein to the contrary, this agreement will remain in effect even after your participation in a project is terminated. Whether or not you are and remain eligible to participate in any of our services will be determined by Connecther in its sole discretion. You may terminate your participation and status as a user of the Connecther website and Connecther's services at any time and for any reason by sending a written notice of termination to Connecther as a Project Partner or Individual User. Connecther may also terminate your participation in the Program and status as a Project Partner or Individual User at any time and for any reason, giving notice to you at the e-mail address you supplied to Connecther upon your registration.

I. ENTIRE AGREEMENT

This agreement between you and Connecther is in its entirety and it cannot be modified without the written consent of Connecther. This agreement also cannot be modified orally. If any part of this agreement is deemed to be invalid, the rest of the agreement will still have effect. These Terms and Conditions were last updated on March 10, 2010 and they may be updated or changed at any time.
